Terms & Conditions

These Terms and Conditions govern your engagement with Pendulum Atelier and the watch repair and restoration services we provide. By leaving a timepiece in our care, using our website, or submitting an enquiry, you acknowledge that you have read and understood these terms. We encourage you to take a moment to review them before proceeding.

1. Definitions

Throughout these Terms, the following words carry the meanings described below:

  • "Agreement" — these Terms and Conditions, together with any service quotation or intake form.
  • "We / Us / Our" — Pendulum Atelier, operating from 23 Jalan Telawi 3, Bangsar, 59100 Kuala Lumpur.
  • "You / Client" — any individual or entity that submits a timepiece for service or uses our website.
  • "Service" — any watch repair, restoration, cleaning, or related work performed by our workshop.
  • "Timepiece" — any watch, clock, or mechanical or quartz movement entrusted to us.
  • "Quotation" — the written cost estimate issued to you prior to commencement of work.
  • "Content" — text, images, and other materials on our website.

2. Acceptance of Terms

Your acceptance of these Terms is formed when you:

  • Submit a timepiece to our workshop in person or via courier
  • Sign or acknowledge our intake form or service quotation
  • Submit an enquiry through our website contact form
  • Continue using our website after these Terms have been made available to you

Our services are available to individuals aged 18 years and above. By submitting a timepiece or placing an enquiry, you confirm you have the legal capacity to enter into this Agreement and that the timepiece is your lawful property or that you are authorised to submit it on behalf of its owner.

3. Service Description

Pendulum Atelier offers specialist watch repair and restoration services, including:

  • Movement restoration for mechanical and automatic timepieces
  • Case and crystal renewal, including refinishing and gasket replacement
  • Full overhaul service combining movement and case work with diagnostic testing

Availability of specific services may vary depending on the condition and brand of the timepiece, and the availability of compatible parts. We operate primarily from our Bangsar workshop and serve clients across Kuala Lumpur and greater Klang Valley. We may accept timepieces by post at the client's risk for shipment.

Turnaround times stated at quotation are estimates based on current workshop load. Actual completion may vary, particularly where parts must be sourced or where diagnostic findings require scope adjustment.

4. Submissions & Intake

When you submit a timepiece to our workshop, you agree to the following intake conditions:

  • An intake form will be completed and signed by both parties at the time of drop-off.
  • You will receive a receipt acknowledging the condition of the timepiece as observed at intake.
  • Any pre-existing damage will be noted on the intake record prior to commencement of work.
  • We will issue a written quotation before any chargeable work begins. Work commences only upon your written or verbal approval of the quotation.
  • Timepieces left uncollected for more than 90 days after notification of completion may be subject to storage charges or, in exceptional circumstances, disposal in accordance with Malaysian consumer protection legislation.

5. Client Responsibilities

As a client, you take responsibility for the following:

  • Providing accurate information about the timepiece, including known faults, prior repairs, and any modifications.
  • Disclosing if the timepiece holds particular sentimental or monetary value beyond standard market rates.
  • Collecting your timepiece within a reasonable period after completion.
  • Ensuring you are the legal owner or have authority to authorise service work.
  • Settling invoices within the agreed timeframe.

Prohibited conduct: You agree not to submit timepieces you do not own, misrepresent a timepiece's condition or origin, or use our website for any unlawful purpose.

6. Intellectual Property

All content on this website — including text, images, design elements, and service descriptions — belongs to Pendulum Atelier or its licensors and is protected under Malaysian copyright and intellectual property law.

You are granted a limited, non-exclusive, non-transferable licence to access and view this website for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

Photographs or descriptions of your timepiece that we may use for portfolio or illustrative purposes will be shared only with your prior agreement.

7. Payment Terms

All prices are quoted in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise.

  • Full payment is due upon collection of the completed timepiece unless an alternate arrangement has been agreed in writing.
  • We accept cash, online bank transfer, and major credit and debit cards at our workshop.
  • A deposit may be requested for services valued above MYR 2,000 or where specialist parts must be ordered in advance.
  • Quotations are valid for 14 calendar days from the date of issue.

Service scope changes: If diagnostic work uncovers issues beyond the original quotation, we will contact you before proceeding. You may accept the revised scope, decline additional work, or request the timepiece be returned in its partially serviced state. Diagnostic work already completed will be chargeable at the applicable rate.

Cancellations: Where work has not commenced, no charge applies. Where work is partially complete, a fee proportionate to the work performed will be due. Parts ordered specifically for your timepiece may not be fully refundable if the service is cancelled after ordering.

8. Service-Specific Terms

Movement Restoration (MYR 950)

  • Work is performed using manufacturer-compatible or period-appropriate parts where originals are unavailable.
  • We do not warrant that any movement will achieve its original factory timing specification, particularly for movements with age-related wear beyond practical restoration.
  • Any replaced components removed from the movement can be returned to you upon request.

Case & Crystal Renewal (MYR 1,400)

  • Polishing and refinishing is performed in accordance with the original finishing pattern of the case. We will not apply a different finish without your explicit instruction.
  • Certain surface blemishes — deep gouges, pitting, or corrosion — may not be fully removable and will be disclosed at the assessment stage.
  • Water-resistance restoration is offered where applicable, but water resistance cannot be warranted for vintage cases with deteriorated sealing surfaces.

Full Overhaul Service (MYR 3,800)

  • This service includes a 48-hour timing test and power reserve verification for automatic movements.
  • Results are documented and provided to you at collection.
  • The overhaul encompasses all elements noted in the service description. Should any component require specialist attention beyond the defined scope, a supplementary quotation will be issued.

9. Disclaimers

Our services are provided with care and skill, but we do not offer any representation that a timepiece will be restored to factory condition, particularly for pieces with significant age-related wear, previous amateur repairs, or unavailable original parts.

Website content is provided for informational purposes. While we aim for accuracy, we do not represent that all information is current or error-free at all times.

We are not affiliated with any watch manufacturer. Brand names mentioned in service descriptions are for identification purposes only.

10. Limitation of Liability

To the extent permitted by Malaysian law, Pendulum Atelier's total liability to you in connection with any service shall not exceed the amount paid for that specific service.

We shall not be liable for:

  • Loss of use or sentimental value
  • Pre-existing faults not disclosed at intake that manifest or worsen during service
  • Damage caused by force majeure events (flood, fire, theft, civil disturbance)
  • Indirect or consequential losses of any kind

In the unlikely event of damage caused by our negligence during servicing, we will discuss an appropriate remedy with you — which may include repair, partial refund, or contribution toward replacement — depending on the circumstances.

For timepieces of significant monetary value, we recommend informing us at intake so that appropriate care levels and insurance arrangements can be discussed.

11. Indemnification

You agree to hold Pendulum Atelier harmless from any claims, costs, or liabilities arising from your breach of these Terms, your provision of inaccurate information, or your submission of a timepiece you were not authorised to service.

12. Termination

You may withdraw a timepiece from service at any time before work commences without charge. Once work has started, cancellation terms as described in Section 7 apply.

We reserve the right to decline a service engagement at our discretion — for example, where the condition of a timepiece presents risks beyond the scope of our workshop, or where parts are no longer obtainable.

Terms that by their nature survive termination — including payment obligations, intellectual property provisions, and limitation of liability — shall continue to apply after any termination.

13. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any disputes arising from this Agreement shall be subject to the jurisdiction of the courts of Malaysia.

If informal resolution is not possible, the matter may be referred to the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia) or other appropriate authority under Malaysian consumer protection law.

14. General Provisions

  • Entire Agreement: These Terms, together with any intake form or service quotation, constitute the complete agreement between you and Pendulum Atelier in relation to the services described.
  • Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect.
  • Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
  • Assignment: You may not transfer your rights or obligations under these Terms without our written consent.
  • Notices: Formal notices should be directed to the contact details in Section 16.

15. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our services, legal requirements, or operational practices. When changes are made, the updated Terms will be published on this page with a revised "Last Updated" date.

Continued use of our website or submission of a timepiece after updated Terms have been published will be taken as acceptance of the revised Terms. For significant changes, we will endeavour to provide notice through our website or by direct communication where contact details are on file.
